Folks,
Let the ilks of sherman and zazona types bark. We all are wasting too much time reading this and responding to this post. Please disregard and don't comment on these posts; its of no use.
Let us all focus on the rally and the things that we have to do to make it successful and not waste our energy on this.. Each one of us has to work to make this rally a success, that is a vow each one of us will take.
Consider this to be the last post from our side.
Finito... The End...
Just before ending, one thing I would like to say to sherman and zazona types.. Please go ahead and do what you have to do; have the strangest notions in your mind about numbers in the rally, we not succeeding etc.. We will prove you wrong in every sense of the word. We will do what we have to do! Amen..

Hi Guys.. need someone to answer my question, if possible. Thanks in advance.
My PD is Sep 2004 ( EB2 India ) and I was also July 2007 filer, and also the victim of my 485 being closed by USCIS nebraska in May 2008, which anyways got reopened within a month after supplying necessary documentation ( Approved I140 and moved to new company etc ) . I work on an EAD now. My question is
1) My AP is expiring in mid October. Should I file for a AP renewal and spend extra money ? Do I have a chance of getting GC in September ? Btw I was told last year at USCIS newark, NJ office that all the background checks and other things show clear on my case.
2) I moved my apartment 2 blocks away early this year, but my city and zip code are the same. If I file an AR11 ( change of address ) , will it raise any flags, since I have read on this forum that a change of address sometimes prompts an RFE. I am a bit scared of going through ups and downs, so I just feel like not doing anything which might create any kind of issue after so many years of pain.
Please give your insight. Thanks so much in advance !

Some people like me who really love what they do and dont prefer changing jobs have reached a point where they are begining to think if it is all even worth the wait.
Just for curiosity: If you love your job and content with your current position, then what is the problem in waiting?

Here is another story. My spouse has been working for the same firm for 7 years now. After finishing her Cost Accountancy in India, she received MS in Accounting and MBA in systems management from a top B-School in the US. Even then, her case was filed under EB-3, after a two-year wait because her company does not immediately process GC for newcomers. Her case went to the Dallas BEC for LC clearance in 2003. After that we havent heard a peep from the Dallas BEC. Her lawyers, one of the top law firms in the county, are not helpful at all. They wouldnt tell us our case number so that we can check the status ourselves or tell us what they are doing to pursue the case. Apparently, the company has been burnt by employees who have left the day after getting their GC. Hence, the Law firms motto is mum and the HR department in the company is not doing very much to assist. Besides assuming that miraculously the LC is approved, the EB-3 for India is so badly retrogressedwell, we feel hopeless. Moreover her company has a bond agreement, if anyone leaves before completing 2 years of full-time service after receiving the GC they have to pay a fine of 10 grand. Her job involves extensive travel, which is really putting a strain on our family. However, we are in no position to change jobs, even within the same firm. I can apply, but then, it is another 6 grand for processing and I will be way back on the line, and the standards for EB-1 is so exacting and the paperwork required is so daunting that it will take months to get all the paperwork and letters together. And, my school is not very enthusiastic about sponsoring people under EB-2. Anyway, whats the point of filing under EB-2 now?

I would say if you are getting a good opportunity, do not loose it for the sake of September Visa bulletin. Do not send the AC21 documents to USCIS. If RFE comes, you can respond quickly by hoping that they will approve your case at the same time. In case, if you don't get RFE (chances are more), you might get GC right away.

We have been fooled so many times in the past with the predictions of the visa allocation being over etc. I would take this with a grain of salt.
Whenever someone starts the thread with a line "A friendly IO told me blah blah blah"....my response is *YAWN*

Hard to believe as the very same DOS moved EB2 dates "Forward" for September bulletin. So make be some fake.
Anyone had a chance to talk to NSC today? Did they have anything to say?

Very well said. I have been on IV and actively participated in a lot of campaigns and events and interacted with a lot of people from different walks of life, different nationalities, different situations etc ... WHat I have noticed is, everyone has their own opinion and stay entitled to their opinion. Everyone wants to be judgemental through their opinion.
Now, lets all for a moment - step out of our "legal immigrant" shoes and step into the shoes of someone who has to decide what to do? As a decision maker, what will you do? Everyone has their own opinion to which they are entitled and thats whats happening.
Now, ocne again - step out of your legal immigrant shoes, and say, for some reason, you lost status and are deportable - what will be your opinion? Would you say "Shakle me and put me in detention center?"
If you are in poverty and and have no food for 2 days, you may go grab a bread from a store and run to a safe place and eat it - will you talk all these rules about shop lifting .....
If you catch a hungry child shoplifting to eat a bread will you PUNISH him? Ir will you try to do someting to make things better for him?
All you have to do is to come out of "the hate and hard" thinking and try to look at things in "rational and meaningful way"
Hate no one for what they are or how they are. Try to see if you can help. Just help.
I have been living in US for close to 10 years now and though I am proud of fellow Indian community and their achievements, I have also noticed how the community is divided and oponionated. Forming so many sub groups, promoting caste feelings, fighting each other, trying to piut down other fellow community members, lack of unity and what not ....
If everyone in this world want to be considerate and help - then there will certainly be a day when we can see a world without poverty, wars and all the issues we are having today.
1. " for some reason, you lost status and are deportable - what will be your opinion? Would you say "Shakle me and put me in detention center?"
What I and the majority of people in this forum do is their best to make sure they dont loose their status. If on the other hand it happens I would return to India and consider all options to reverse it. What I and majority of people here wouldnt do is stay here illegally. Loosing you status is not a crime for which you are shackled and put in a detention center. A repeated pattern of violating the law is.
2. "If you are in poverty and and have no food for 2 days, you may go grab a bread from a store and run to a safe place and eat it - will you talk all these rules about shop liftin".
This analogy does not apply to anyone on this forum as "Legal immigrants" plan for contingencies. Even if it happens I would ask for food as a favor from some one rather than break into their house and demand it as a right!
3."f you catch a hungry child shoplifting to eat a bread will you PUNISH him? Ir will you try to do someting to make things better for him?
We are talking about a 35 year old woman with a repeated pattern of ignoring the law, not about a hungry child. This is a completely false comparision.
4. "Hate no one for what they are or how they are. Try to see if you can help. Just help."
I dont hate them, i just think what they do is wrong and they shouldn't be rewarded for it. If an illegal comes asking for food, I am pretty sure every one will be happy to feed him. But if breaks into my house and starts raiding my refrigrator, he better watch out.
You are a senior member of IV and I know IV has concluded that any chance of meaningful immigration reform goes hand in hand with that of the illegals. I understand that, and have made contributions as and when i could to IV. But that still doesnt make illegal immigration "right".

Guys,
Looks like my pledge will never ever happen  I am itching to press that button to send $500, but the forum is not helping the cause.....
Come on IVians ..... Is it so difficult to make you adults understand that the thurst we need year would be the biggest...do you want the tech lobbyist to increase only H1B's (remember they have lot of money). Guys we will lost in the crowd if don't prepare ourselves for the forthcoming face offs next year. We are closing in on the traget, but only thing which can make it happen is more members and more money.

I have a nine month old and I can understand your feelings......
Now about legal recourse - the best thing is to get out of any kind of mess. You were aware that you must not hire a nanny illegally and now you pay the price. No problem. Just say good bye to her and be careful next time
Chandu - Can I Ask you something here.
Just today I was reading on the ac21 thread, how you lamented that we as a community dont stand up for injustice and how some folks are worried that writing AC21 letter may mess up their situation somehow ......
And right now , you are suggesting that the best thing is to get out of any kind of mess. So the person knew he was doing something illegal and his 8 month old kid was beaten up and you feel he paid the price and now No Problem and he should move on ???????????
Somehow, this 2 + 2 isnt equating 4 for me. What am I missing here ?
Sorry Chandu but I'm disappointed with you right now.

I have a problem where my "Given Name" is entered as "<first name> <last name>" in my passport (India). The "Surname" is left blank. I have been in the US for 7 years now and it has never been a problem so far. I usually enter the "<last name>" in the last name column on all documents. I wonder if this will cause problems during the I485 name check stage. Any one here who can throw some light on this issue?
I realize that the question is a little weird, I appreciate any response.
Thanks
I have a similar problem with my name in the passport being not broken as first, last and middle. I never had any issues until an immigration officer pointed it to me while extension visa stamping. As it was hand written in the passport I just mentioned that it would have been an error and I really don’t have time to get it corrected. She gave me a stare and let me go at that time.
I filed my I-485 and had no issue with anything including name check which I assume got cleared. My passport is expiring soon may be I'll get it sorted out at that time. I hope this helps.

I say again, go to the cops. I understand you did wrong when you hired an illegal immigrant, paid her in cash, etc. It shows your wrong intentions. But in all honesty, that argument is mute, you are not responsible to verify someone's immigration status, I bet you can argue that with an attorney. You are dealing with a much more serious issue here. I pity the guys who suggest not to complain. Either they dont know what their son means to them, or they have simply messed up their life prioritizing GC over every thing else.
I don't support hiring an illegal nanny or getting someone from India. But what is done is past. Bigger crime here is someone hit your son. If I were you I would have made her life hell, I would have gone till any extent to make her realize what she did. I give a damn about the GC. My first priority is my child. If someone adult hits my child and I come to know about it...I am his dad for god sake. Protect your son so he can call you dad.
Hello guys,
Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.

I don't think you have waited for 6 years after your PD to be able to file for EAD/AOS Benefits... the whole thing is messed up... There are people who filed during July Bulletin Fiasco and there are who could not even though their PDs are before yours. So do you ask them to SHUT UP ?
