Yes; he was out of status from March 2003. However; he had a valid I-94 card until February 2004. He didn't have a valid I-94 from February 2004 until april 2004.

If his I-94 card expired in March 2003 then he would have had unlawful presence from that date forward and since it was more then one year then he would have been subject to 10 year bar.

Few big question we need answer tow
1) Why is there no forward movement of dates if there is visa was available from this year/quarter's quota... what is up with retrogression?
2) If visas were unavailable, why was the fucking date advanced to Sept 2006?
4) Why was FIFO not followed during adjudication?
3) How the Fuck long do they need to determine the backlog ..? we need USCIS to publish the backlog stats. Without that visa bulletins are pointless?

Is IV only for those who have filed I485?
I gave my opinion and people gave me lot of reds. There is a majority here who already have EAD and have filed I485. You people do not care for those who are less fortunate and struggling in the early stages of the process. If July 07 had not happened, all of you would be asking for I485 filing option today.
By giving reds to people who disagree you will drive people away and make IV only for those who have filed I485 and not for the entire EB immigration people.
Firstly, why do you care about reputation on the forums (reds)?
Secondly, did you try the process described by NolaIndia?
Here is the process as described by NolaIndian:
"The person who came up with this idea needs to PM or e-mail Pappu or Administrator and get some feedback if IV Core supports this. If you get the yay from Pappu, then form a small core group who will tacke the operational aspect of this idea and keep it moving forward. The "posts" need to be coverted to "actions". I appreciate your enthusisam to respond to most of the negetive comments and thats a good thing. Try to contain yourself sometimes...otherwise people might just ignore you as another loud mouth.
ya, lets step-up a poll and have everyone vote, as if this is the US congress. And after voting leave it for someone else to work on this and other "brilliant" idea. There needs to be a reality check. This poll doesn't mean anything unless there are enough people to spend time and energy at every level. But ya, lets setup a poll and have everyone vote, it will give everyone a feel good factor that everyone contributed in the advocacy effort, how? by voting in the pool and not doing anything about how everyone votes.

My PD is May 2006. I applied for I-485 in September 2008 when my date had become current. Subsequently got married and now waiting for my date to be current again so I could add my wife.
I had given hope and was not preparing for anything and hence have India trip planned (wife 11th Sept - 1st Nov and I'd go for the month of October).
Given the latest movement, now I think to be safe I should do all that is necessary that in case dates move forward enough for October, I should be able to add my wife to my application. If there are any comments/advice around this, please do let me know.
Also, what would be the things to get ready for her? I hope it'd be alrite that she will be in India while we apply for her I-485?

The reason for this EB2 move is end of year overflow from other categories. I would not expect a significant forward movement next month (if at all there is ANY forward movement).
If the past experience is any indication, you might see a pullback.
You would know in advance if the dates move forward next month and I guess you can reschedule your visit and cut short your wife's trip.
You can prepare all the necessary documentation like birth certificate (translations if necessary) marriage certificate and/or any affidavits (if necessary) in advance.
I don't think your wife can apply AOS (Adjustment of Status) while abroad. She has to be present in USA. She can however file "Consular Processing" while in a foreign country, if that is what you want to pursue.

Your story about how you are affected by retrogression/back log etc. It could be as simple as 'I have a BS in Engineering and am stuck in back log for 2 years and cannot fulfil my dreams professionally' to 'I have a PhD in Nuclear Science and US needs me coz there are only a handful of us!' Anything and everything works.
I have literally recieved stories of stay at home moms (because of H4 they cannot work) to folks who have been interviewed by MIT! The whole spectrum helps.....please please send us your stories...we need all the weapons when we go face the senators on behalf of IV

This is a very great idea, and I think with the aggresive efforts and campaign we can achieve this as we have achieved Julye'07 I485 filling and 2yr. EAD solution, let's discuss and have action plan on how to move forward on this matter, united we can achieve this.

1. Keep your cool.
2. Get rid of that lady.
3. Whatever beating/scolding she has done to your child, it is past. Children are much resilient and recover easily and faster than we adults in case of physical and mental suppression.
4. See, if your parents can come for few months to support you.
5. Send your child to a good day care or hire a recommended nanny from a referral.
Not all nannies are bad. And next time, hire a nanny in a legal manner.

As many are aware, there was a huge rush to buy and sell pre-approved labors during July-August 2007, when all the priority dates were suddenly made current. Tens of thousands of labors were sold by fraudulent consulting companies to many questionable GC seekers, who hadn’t even started the process till then.
It is those substituted labors which are clogging the pipelines now. Just think, last month EB3-I stood at November 2001. Now it is completely unavailable. It can’t possibly be because so many pending labors with such old priority dates suddenly got cleared this month, and beneficiary of these labors filed 140+485 together. I seriously doubt that a candidate whose labor is pending since such a long time is even keeping that GC process alive. In all likelihood he/she must have moved on in life.
There is only one explanation. These labors were already pre-approved. It is the attached I-140 on these labors that are getting approved rapidly. And the subsequent I-485 petitions on these applications are depleting the visa numbers.
