AILA has reported a very interesting or confusing DOS LegalNet Office letter which one of the members received towards the fact that the consular posts had already been allocated their numbers for the month of July prior to EB visa numbers becoming unavailable on July 2 and that the posts may continue to use their July allocations of EB numbers, and continue to issue Immigrant Visas for the rest of this month, July, for those applicants who were scheduled for IV interviews in July. Hm.....................................
It thus appears that those who are scheduled for IV interviews should keep the schedule of interviews in July regardless of the current Visa BullEtin fiasco. Readers may also ignore our previous message on the consular processing. It is an extremely confusing time. Please check the visa interview appointment letters from your American consulate. Can I submit a new application for EAD renewal online when my paper based application is pending. Its been over 4 weeks and my check is not cashed and current EAD expires in 7 weeks.
Would it invalidate the first application ? The first application had a missing question that was rejected and I submitted it back about 4 weeks back, and no check encashed or response till now, so I was thinking if submitting an online application would help.

Hi,
I lost my job on 7th Nov 2008. On the same day I received the offer letter & my H1 transfer was applied by the new company. This new company goes by rules, so they are waiting for the H1 receipt. They have not applied H1 trasnfer in premium processing.
My questions are,
1.) What time is it taking to get a receipt by USICS? (NON Premium Processing - I�m in NY City - so probably Vermont Center)
2.) Do we have any rule in written (Official), that as soon u apply for transfer, without getting the receipt; you can work for the new employer?
(So I can show it to my new employer)
3.) Can I follow with USICS? Have they received my application for transfer? How to contact them? What reference should I give them, to find my application? (I don�t have tracking number - FedEx receipt)
4.) What is the time taken for the H1 Paper, to be delivered after receipt, by USICS?
Trust me this is so frustrating, U can�t join because of all this paper work.
Please respond ASAP.

As we all know that getting a GC in US is next to impossible with dates getting retrogressed to Jan 1 2000 and no sign or indication of it getting better in near future I'm strongly thinking to apply through AINP program for Canada immigration.
I truly believe that the comments and suggestions posted on this forum are very genuine, latest and by expert and experienced people. Believing this I am expecting all pros/cons of going ahead with Canada immigration.
If anyone had done this then please share ur exp and thoughts. The asking fees by the Attorneys is too high and that doesn't includes Canadian Govt. fees. So please suggest on this.

that is old stuff and also scary stuff for some people, even if old visas's are being recaptured, it was being done only for Schedule-A folks (nurses). So for all other EB categories where the only form of relief they are seeing is from possible recapture, if nurses take away those 200k (per Ombudsman its about 218K lost visas) then thats another big hope gone.

I have a question regarding filling of I485.
My wife got her H1 approved in November 2006 and she got her SSN in december and her company has not put her on a project.
I would like to know will there be any issue if I file her as my dependent on my I485 application.
Her H4 visa on the passport is already expired.

both of us are physicians working on h1b visas .we have ead's.i want to do a fellowship.i believe i cannot do a fellowship using my ead.can i use my wife's ead,showing myself as a dependant?all help from the gurus will be greatly appreciated.thanks.
EAD is employment authorization document. Your analogy is like -
"Can I use her driving licence to drive around town". I am not sure if that is what you meant.
If you want her to be the primary applicant in your GC application and then use EAD as a dependent, that is possible. You will lose your H1B status then.

Your employer can revoke 140 in once that you filed i-485 within 180 days .

Several reasons, some of which were mentioned. You need Adobe Acrobat to edit the document. PDF format is cross platform. To view the pdf output all you need is the free plug-in. In other words, if I created the document in Illustrator and "printed it" to a pdf file, you would not need Illustrator to view the contents.

I usually spend some time every day at my San Francisco Bay Area immigration law office making inquires on pending cases. It is a frustrating process because I rarely receive answers and when I do, they usually are not helpful.
United States Citizenship and Immigration Services ("USCIS") has recently released guidance on how to make inquiries at their Service Centers (http://www.californiaimmigrationlawyerblog.com/USCIS%20update.pdf). They provide a three step process. The first step is to call their National Customer Service Center at 1-800-375-5283. If the issue is not resolved in 30 days, you proceed on to the next step which is to email the USCIS Service Center where your case is pending. The email addresses are:

Hi, I have question about my case.
My family was applied I-485 by my mom's working at the company, and all my family had EAD which is working permit and received SSN with that EAD.
However, 2008 January our I-485 have got denied because of sponsor got closed.
That was the before our EAD card gets expired. So I couldn't renew the EAD card.
So My question is, is there any way to renew that EAD now?
if I still want to work, what does I have to do?

I believe you pay 10% penalty if you withdraw before retirement age, irrespective of whether you reside in the US at time of withdrawal.
However, note that it *might* be possible to save on taxes because you might have very little other US income in the year you withdraw. One dependency here is what tax laws and treaties your home country has on foreign income.

My Wife had the same issue when her H1B got approved. Her attorney (It was his mistake) had to amend the petition . But I remember we got a new receipt number and a new I-94 with the corrected DOB when the final approval came. The bad thing is the amendement application also enters the H1-B cycle of months for approval if not filed under premium processing. We had plans to travel back to India and do stamping at that time. I had to pay this attorney $1000 for PP even though it was his mistake.

Not a legal advise. My 2 cents.
I have never heard of employers pulling credit history to decide upon job offers. I have changed jobs when I had no credit history and when credit history was bad (in 500s) because of outstanding debt (no delinquency though), never had any issues.
Hi, I would like to change job but my credit history is so bad. credit score is in recovery stage. I was unable to pay credit card debt and worked with settlement company and settled all the cards..I paid every thing as of last month. But there were delequencies still appearing on my report..
I am working for a decent company, but i would like to change the job due to uncertainity and very less compensation..
It is very very urgent. Can some one suggest if there will be any issues that matters job switching. In general, will the companies pull credit reports and deny jobs based on credits...Will the credit history matters.. I did not had any foreclosures or bankruptsy.
Plz plz suggest..looking for a way around..

There are no soft LUDs on my 485 after 7/17/2007. What does this mean? Is there a way to check if I am stuck in name check?
I see many people with later RD and PD getting soft LUDs. Is anyone else in the same boat? Please advice..

So now we are tracking Soft LUDs as well :)
Not getting a soft LUD is the norm. It just means your case was not an exception and you can't expect any miracles ..Yet! But Getting LUDs is not guaranteed to result in GC approval either. So please stop worrying about every little thing and enjoy your life... (Like I'm doing visiting this forum every now and then ;)
