Hi,
My passport will be expiring in next 6 months. I do have an appt pending with US embassy Bombay. I have some queries, if someone can please guide me:
1. What happens to old passport. I took Appt with old passport number?
2. Can I keep my old passport?
3. Is it OK to go for new renewed passport? Or will it impact the H1B stamping and interview process?
Pls suggest.

For all the friends at IV who have already received their EAD's and/or renewed their EAD's i wanted to ask how long does it take for a person to receive their EAD after filling their 485 provided their date is current. Is filing for EAD an additional step to filling a 485 once the date is current?
2nd scenario: If i decide to change my job and my I-140 is approved with my current employer. The new job is the same level and category as my job description on my current I-140, in a new company. Can i port my PD with the new employer without any affect of I-140 withdrawl from my old employer or will the porting need to be executed prior to my old employer pulling the I-140 petition? I have some understanding about the situation but i wanted multiple opinions just to firm my understanding. Thanks in advance and may GOD help us all through the wait period to get our destinations.

Hi Guys,
How important is NAICS code. Can someone has same SOC code but diffrent NAICS code can interchange . I read only SOC codes, discription and wages matter.Is it true.

Are there any rules that you need to leave a country during 30 days after your H1-B got approved. Almost all my friends needed but my lawyer said that I don't need to. I am confused what if he makes a mistake.

TSC online system seems to be still down - I tried adding a new receipt number and its not accepting, I talked to my lawyer and she mentioned that she heard same from a bunch of her other clients. Since my EAD is still valid for another couple months, I didnt try to go for InfoPass yet.
These days people are getting RFE's left and right and TSC's online system is down just in time :( In many cases it may not be a big deal (to answer the query in time) but having online system updates was useful to prepare for any such thing. Now we have to wait for the letter.

Individuals who apply for a non-immigrant visa must be admissible to enter the United States. Inadmissible grounds to deny entry into the U.S. include, but not limited to the following:
Communicable disease;
Criminal record involving crimes of moral turpitude;
Possession of or trafficking in a controlled substance;
Trafficking persons;
Involved in money laundering;
Previously removed (deported) or previously overstayed a period of admission to the U.S.
If a non-immigrant visa holder subsequently becomes inadmissible and thus ineligible to enter the United States, depending on the inadmissibility ground, the visa holder may apply in advance of travel for a temporary waiver of inadmissibility. The waiver application is applied directly to U.S. Customs and Border Protection (CBP) prior to travel. Along with the signed Form I-192, Application for Advance Permission to Enter as Nonimmigrant, the applicant must submit the filing fee of $545, an official police record from country of nationality, proof of citizenship, and supporting documentation regarding the inadmissibility showing rehabilitation and character reformation. For questions concerning eligibility of the temporary waiver application, or any other area of immigration, call Kraft & Associates at 214-999-9999.

Sure. You need to work outside the US for the sponsoring company in a managerial capacity for 1 out of the 3 years prior to filing the I140. So if you are on a H1B and are a manager, you can sign up for an assignment abroad to fulfill that requirement.

My employer let me signed 3 contracts. First was for the year 2006 then two for 2007. They said they just changed a few things but it is the same. The previous two contracts said if ever employment is terminated prior to an agreed date, reimbursement to the employer will be pro-rated. The 3rd contract was changed to reimbursing the employer the full amount of the contract which means H1B fees, recruitment fees, sign-on bonus and reimbursement. I was not aware that they've changed the reimbursement because I did not read the third contract anymore because they said it's the same.
Is it legal for the employer to charge the H1B employee the H1B fees, recruitment fee, sign-on bonus and reimbursements? I applied directly to my employer but they hired a recruiter and was just made aware of the huge amount after working for 3mos with them. They never gave me a copy of the total amount of my contract until I asked for it.
They filed for my I-140. It was already approved and just waiting for the I-485 to be filed.

Unless you are getting your mother-in-law to the US before you get your GC, it may become a factor but otherwise, it will have no issue

My 140 (filed concurrently with 485) was approved on Aug 17th. Ever since 08/17 I have been seeing LUD's on it everyday. In fact there was a LUP on 08/19 Sunday! Any ideas what's happening? I think something is going in CIS.
I got a LUD on my November 2005 approved I 140 on 03/13/08. My I 485 reciept date is August 7th, 2007. I got all reciepts, EAD and FP notices. I am in EB3 category. Need to know why LUD on I 140. :confused:
