Q.1) I understand you can't file 485 for your spouse if PD is not current but does the PD need to be current to add your spouse as a dependent on your 485 application w/o filing 485 for her?

Wait for 15th July- If PD is current in August - don't apply in July , if not, go for last week of July
Since there are ton of cases, one will not get FP in traditional 30 day but they will get it around 60-90 days (assumption based on ,immigration and immigrationvoice forums and comparing influx with 1999-2000 dates becoming current situation. Yes, i have taken into assumtion that there were 195K h1's that time )
Ok so it's september already and you got your FP! But you want to have a total period of 1 year without losing your pd or your file in queue.
If dates are current in August then rescheduling september FP will go to December/November at the best!
Then you complete the fp process and the average time is 8 months - considering the flood of applications and dates will definately hit retrogressing in Nov-dec, They will assign cut-off dates. lets assume they go back to where the dates were in May/June 07 , then ,you will need to see where you are in the queue. There are some creative ways of generating an RFE (without getting 485 rehected due to initial evidence)- but it's not recommended ;-).

My mistake.. I was under the impression that my contact info is visible. I have already met with my local congressman and submitted a memo. I have got a reply saying they would address this issue as part of impending CIR bill. I was not sure what to make of it, whether he is pro and anti retrogression..
Thanks for updating the profile. pls set up a conf call in your chapter. Announce it on the forum and get people to PM you their email and phone number and then invite them for the call. This will ensure you have commited people who genuinely want to work in the local chapter with you. send an email to IV if you have any question and we will help you. Get in touch with other state chapter leaders that are active (paskal, janilsal, varshadas..etc) for inputs since they are also meeting lawmakers. It is a community effort and everyone needs to make some efforts in order for us to succeed.

On Aug 11, 2007 - I 140 Denied Due to Ability To Pay issues
Description for denial ( I have also attached the denial notice)->
They looked at years 2003 to 2006 history for I140 since PD is JAN 03.
* Reason 1 - Lower salary than specified in labor
Preferred Wage in labor - 78,750
W2(2003) - $76,850; W2(2004) - $75,638; W2(2005) - $31,652;
W2 for 2005 is less due to company merger. I have another W2 from new company for 2005. I moved to another company due to merger but lawyer continued GC throgh old employer since the both companies exists after the merger.
* Reason 2 - negative net income of the petitioner
2003 (-$537,841); 2004(-$445,493); 2005(-$527,298); 2006(Not Submitted);
* Reason 3 - 2003 and 2004 OK but net current assets are -ve in 2005
and my lawyer did not provide 2006 information
Acceptable Assets Aceptable Liabilities Net Current Assets
2003 $4,272,733 $3,789,359 $483,374
2004 $4,871,615 $4,660,879 $210,736

Your application was denied not with a combination of
Reason 1 , 2 & 3, but each reason by itself was insufficient to prove ability to pay. Your employer should meet atleast one of these to prove "Ability to Pay".
It's deplorable that most attorney's don't educate small employers on meeting ability to pay even before filing the Labor Certification.
I would suggest that you appeal the case with supporting statements from a good CPA and in the meantime go for a fresh labor certification.

There is No sense is passing a rule/memo like this where the consultant/Employee is affected badly.USCIS changes their views and rules on a need to need basis which should be struck down by the court of law.We as immigriants to US and we have every right to fight this rule and also need to support the need to revoke this rule.
Even a criminal gets a chance to plea in the court as not guilty,but we dont get a chance beyond the immigration counters.We continue to contribute so much tax dollars and all of that shouldnt go in Vain.People have lives and Families and they can never build or continue the future invested here in US.
I agree that the rule will make sense for new H1�s or extensions but i dont not agree that it should be passed on people randomly.USCIS should force such a rule on the Employer and not go against H1 Employees.
This Rule should be taken by employers to implement new standards of practicing consulting and not try to find loop holes in the system.Obviously we should have seen this coming which is ripple effect of all the employers exploiting the Consulting business.

Not a bit. If you want I can give you a plenty... L1 is for intercompany transfer. But So far I have seen companies put people only at the client place and their salary is starting at 32K and they are put up at extended staty, asked to share the cab or car. So let me know if you want and I can directly let you talk to those guys.

So our common goal is to fix the broken system, remove the employer's undue advantage over the employee. No matter if they are MNC or desi consulting companies. Why the employee is tied to the employer when there is the need/demand for the skill set. Thats the only thing which is driving down the wages.
I fully agree with this. L1's being placed at Client's place is ILLEGAL. I have several proof's of this. TCS, Infy, CTS and LT do FAVOR their employees with a gift of filing in EB1 because these guys WOULD not complain to any one what they are paid and their benefits.

a friend of mine was involved in a rolling bumper car accident ... the lady comes back year and a half later and files a case aganist him..his insurance lawyers fought the case for him.... they won..
The question is..how fast was the car on impact...check with your iinsurance lawyers they may be able to assist you...
dont even think of running away..they issue arrest warrants for traffic ticket violations sometimes...so urs is a little serious..;)

CIS awhile back reported that they only have 60K I140 applications pending. So 125K I140 applications can't be pending..
My understanding is VSC and CSC are working on H1B and NSC and TSC work on I140, I485s.
