For all of you who have got standard responses from USCIS, please do something about it. Call the local senator, file DHS-7001 with CIS Ombudsman, send a letter to USCIS secretary Napolatino, call TSC using POJ method, etc, etc.
If you are current, they need to look at your file. Case under review means nothing at all....my case was under review since July 20, 2009. Finally, i found out that my file was sitting in the storage and collecting dust.
As other previous posters have mentioned, you should try calling TSC/NSC on Thursday/Friday evening. I found out that the IOs were in a better mood, as compared to my calls on other days (specially in the morning/afternoon).
If you need details on the IO I talked to, I can provide it to you offline. I am still trying to reach that IO (need to say a big thank you) but have been unable to talk to him/her so far.

I found this only today.. I do not work for this employer since Jan 2008. On EAD now.. 46 days passed since the date mentioned.. not sure what is this about..

Pushing for immigration reform that would legalize as many as 11 million undocumented immigrants, Sen. John McCain was preaching to the converted Thursday night at a packed town hall meeting that at times seemed part stump speech for the Arizona Republican who's eyeing a run for the White House.
''Our legislation will be taken up in the United States Senate within the next weeks and you've got to go to work,'' McCain told the more than 1,000 cheering and chanting supporters at a cavernous auditorium at Miami Dade College's Wolfson campus downtown, urging all to garner grass-roots support for the bill he and Sen. Ted Kennedy, D-Mass, have co-sponsored. ``You've got to work not only here in Miami-Dade and around Florida but around the country.''
The town hall meeting, which had the feel of a campaign rally, brought together disparate groups -- Cuban and Haitian immigrants, business and labor union leaders, Mexican farm workers and South American illegal immigrants -- all united behind the common agenda of helping the McCain-Kennedy bill prevail in the coming congressional debate.
McCain's Miami visit, which included get-togethers with Cuban-American business leaders and young immigrant students, came on the same day that the Bush administration extended for a year a controversial temporary worker program for 304,000 Central American illegal immigrants living in the United States.
MOST GENEROUS BILL
The McCain-Kennedy bill would grant temporary work permits to illegal immigrants and then after waiting six years and paying a $2,000 fine, it would enable them to apply for green cards.
It is the most generous of the bills now before Congress. A bill passed by the House in December seeks to criminalize illegal immigrants, impose stiff penalties on employers who hire illegal immigrants and target for prosecution anyone, even religious or advocacy groups, if they help undocumented migrants.
SALVADORAN AID
Salvadoran President Elias Antonio Saca, meanwhile, teamed up with South Florida's three Cuban-American U.S. representatives in Miami Thursday to thank President Bush for ordering the continuation of TPS.
Emilio Gonzalez, the head of U.S. Citizenship and Immigration Services, told The Miami Herald that TPS extension reflected an administration policy to "help our neighbors and do the right thing in their time of need."
The Miami Herald reported last month that Homeland Security officials were debating ending TPS for Central Americans. That spread alarm in the immigrant community, triggering intense lobbying of the White House by Miami's Cuban- American representatives and Central American community leaders.
Gonzalez said the program was extended for a year instead of the regular 18 months because that was the ''consensus'' decision.
Saca said that when he meets with Bush in Washington today he will also urge the president to push for broader immigration reform.
Reps. Ileana Ros-Lehtinen, Lincoln Diaz-Balart and his brother Mario Diaz-Balart gave Saca credit for helping to keep the program alive by lobbying hard on the issue.
''He is the hero of the moment,'' said Lincoln Diaz-Balart.
Critics of the TPS program believe it has become an entitlement for certain illegal migrants -- while proponents argue it represents income and stability for poor Central American countries.
The extension covers about 225,000 Salvadorans, 75,000 Hondurans and 4,000 Nicaraguans. Extensions will expire Sept. 9, 2007, for Salvadorans and July 5, 2007, for Hondurans and Nicaraguans.

This means that if your priority date were to become current sometime soon, but your case was at USCIS, and they were not issuing receipt notices because your case was being held in the mail room, you would have no choice but to recreate your case, pay new fees, new medicals, photos, and file again.
There is also an outside chance that USCIS could keep your filing fees, which would make you subject to paying them again with a new filing.

I think by holding applications USCIS is trying to reduce the number of people from filing in july. This armtwisting tactic will reduce unnecessary overload in their mailroom and reduce the number of people in the july filing class as far as any lawsuit is concerned. Maybe just another move to reduce losses or any complications if any lawsuit is successful at some time. The smaller the number of beneficiaries the smaller the headache.

So you made the problem statement which every one around here knows. What are your action items for poor souls like me who do not know how to take on, a person with successful TV show , using a placard and a megaphone ? What would be your solution ?
I think WD already posted the action items - questioning the radio shows fairness and if they feel they have a responsibility in not inciting hate crimes toward immigrants both of which are very good points to raise. Lou Dobbs already has a huge platform from which he is spewing venom on immigrants and the last thing he needs is another medium - radio - to carry it even more.
GC is a pre-req to becoming a citizen and once you become one it is hoped that you would voice your opposition even more against hate-mongers like Lou. What he is indulging in is despicable - using the average American's economic insecurity and playing it off againts immigrants - & one does need to speak out if not for yourself atleast for others that can't do it themselves so WD is doing the right thing urging people to call in.

Again, I am not here supporting more numbers or less number in H1B. Because this forum and our organization is nothing related to H1B. We are for Employment based Green Card reforms. I rest my case....Thanks for interesting (and correct) opinions.
Agree completely. IV is for EB GCs and not concerned with H1B. I simply hope that Senator Grassley takes EB into consideration or at least does not oppose somebody else in introducing EB legislation, even on condition of his reforming the H1B process (which I do beleive is needed nonetheless).

I don't know what this petition is going to do. Atleast it will convey to CNN top brass that there are people out there who won't tolerate such lies. Maybe it won't do anything now but we must continue our efforts and oppose such false propagation of information whenever we can.

@krishmunn thanks for your analysis too , i had sent him a bunch of emails about 10 of them and he never responded to them, when i called him about why is he not replying to my emails he said i cannot have any email conversation with you, it did not strike me then why ? but after talking to all the guys here i understand why he said so, i do not know if this would be enough . but i am just preparing my packet to send to DOL
@PrinceVA i really appreciate your help and your kindness at least someone in the fraternity doesn't believe in finding the nationality before helping. Well i really appreciate your concern and i wish that you were a part of my employers team, but i have my tickets booked and bags packed . I would now empower people from all over the world to come a little more prepared on H1B to US. I admit to being dumb before landing here but i have gotten my much important experience which i will pass on through fake busting.

Did you keep new filing fee also? When I spoke to custumer service by 800 number call, she said you have to keep new check and original sealed medical along with duplicat filing.Wish you all the best!
Same as me :D but for the fact that I sent in mine without medical. What do you guys think the chances are of USCIS sending an RFE instead of rejecting the application outright?
Btw..I did "re-file" with completed medical yesterday. I am just hoping they accept my July 2 app. to avail, if any, advantages of RD.
